Prairie Toyota Family Photo Album Official Contest Rules

1. CONTEST SPONSOR: The Prairie Toyota Family Photo Album ("Contest") is being conducted by participating dealers (each called a "Participating Toyota Dealership") of the Toyota Dealers Advertising Association - Prairie Zone and Toyota Canada Inc. (TCI) (collectively the "Contest Sponsor"). The Prairie Zone includes: the provinces of Alberta, Saskatchewan and Manitoba; the City of Kenora, Ontario and its immediate trading area (as defined by TCI); the City of Cranbrook, British Columbia and its immediate trading area (as defined by TCI); and The City of Dawson Creek, British Columbia and its immediate trading area (as defined by TCI) (collectively, the "Prairie Zone").  (For more specifics on what constitutes the trading areas for these cities please see the trading area maps listed below).

This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to the Sponsor and not to Facebook. The information you provide will only be used for the administration of this Contest and in accordance with the Sponsor’s privacy policy (see below). Facebook is completely released of all liability by each entrant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to the Contest Sponsor and not Facebook.

2. ELIGIBILITY TO ENTER: Contest entry is open only to persons who are a legal resident within the Prairie Zone who, at the time of entry, have reached the age of majority in the Province in which they reside and are able to provide proof of identity upon request by the Contest Sponsor (“Entrant”). The Contest is not open to employees (and persons with whom such employees are domiciled, whether related or not) of Toyota Canada, its dealerships, and its and their affiliated companies, advertising and promotional agencies (the “Contest Parties”).

3. CONTEST PERIOD: The Contest Period commences at 1:00 p.m. MDT on Thursday, August 23rd, 2012, and closes at 11:59:59 p.m. MST on Sunday, January 13th, 2013 (the "Contest Period"). 

4. HOW TO PLAY (NO PURCHASE NECESSARY):

There are two (2) methods to enter the Contest.

Toyota Owners: To enter online, during the Contest Period, the Entrant must go online to the Prairie Toyota Website (the “Contest Website”), at http://www.prairietoyota.ca/contest and follow the onscreen instructions on the Contest Website to enter. The entry will require the Entrant to:

  1. enter his/her full name, province, e-mail address, year of vehicle and model of vehicle
  2. accept and agree to be legally bound by the terms and conditions of these Rules and Regulations
  3. upload one unique and original picture (the “Photo”) and/or one unique and original video (the “Video”) and write a unique an original story (the “Story”) about the Photo and/or Video

The Photo, Video, and Story must be in accordance with the specific Submission Requirements listed below in Section 5 and must depict, describe and/or discuss your Toyota vehicle reflected in the entry. At the time of entry, the Entrant must have been the owner of the Toyota vehicle presented in the Photo and/or Video.

Once you have fully completed the Entry Form with all required information, click the “submit” button to complete your entry. To be eligible, entry must be submitted and received within the Contest Period. All eligible entries received during the Contest Period will be entered into the subsequent random prize draw (see Rule 6).

Non Toyota Owners: If you are not the owner of a Toyota vehicle, you may enter the Contest during the Contest Period. The Entrant must go online to the Prairie Toyota Contest Website, at http://www.prairietoyota.ca/contest and follow the onscreen instructions on the Contest Website to enter. The entry will require the Entrant to:

  1. enter his/her full name, province, and e-mail address
  2. accept and agree to be legally bound by the terms and conditions of these Rules and Regulations
  3. upload one unique and original, 50 word or more story, (the “Essay”) about “What You Love About Toyota”.

Collectively, entries by either method of entry are “Entries”. Only one (1) Entry per person/e-mail is permitted during the Contest Period, regardless of method of entry. If it is discovered that you attempted to enter more than once in the Contest Period, any additional Entries will not be accepted and only the first Entry will be valid.

Your Entry will be rejected if (in the sole and absolute discretion of the Contest Sponsor) the entry form is not fully completed with all required information and submitted and received during the Contest Period. Use (or attempted use) of multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Contest Sponsor. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete, or incompatible Entries (all of which are void).

All Entries are subject to verification at any time. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor – including without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Contest Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

5. SUBMISSION REQUIREMENTS: By entering the Contest, the Entrant agrees that the Entry (and each individual component thereof) complies with all conditions stated in these Rules and Regulations. The Releasees (defined below) will bear no legal liability regarding the use of the Entry (or any component thereof) by the Contest Sponsor. The Releasees (defined below) shall be held harmless by the Entrant in the event it is subsequently discovered that you have departed from or not fully complied with any of these Rules and Regulations. Your submitted Photo, Video, and/or Story must never have been previously selected as a winner in any other contest. To be eligible for this entry in the Contest, your Photo, and/or Video, and Story must meet the following specific requirements:

By participating in the Contest, each Entrant agrees to be bound by these Rules and Regulations and by the interpretation of these Rules and Regulations by the Sponsor, and further warrants and represents that his/her Photo, Video, and/or Story:

  1. is original to him/her and that the entrant has all necessary rights (including, without limitation, consent of the photographer, videographer as applicable) in and to the Photo, Video and/or Story (and all individual components thereof – e.g. images, video, etc.) to enter the Contest;
  2. does not violate any law;
  3. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from each such individual and his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence (note: if you cannot obtain the consent of an individual appearing in your Photo, Video and/or Story, then his/her face must be blurred out);
  4. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever; and
  5. is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor (e.g. any clothing worn and/or products appearing in your Video or Photo(s) must not contain any visible logos, trade-marks or other third party materials, including music, unless the appropriate consents have been obtained (note: all identifiable third party products, trade-marks, brands and/or logos (including, without limitation, signage) for which consent has not been obtained by the entrant must be blurred out so as to be unrecognizable); conduct or other activities in violation of these Rules; and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

The Contest Sponsor and/or its promotional agency or designated content moderator (the “Reviewer”) will initially screen every Photo, Video and Story. Any Photo, Video and/or Story that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules will not be posted to any website, and will be disqualified from the Contest. Prior to being posted on a website, the Reviewer reserves the right, in its sole and absolute discretion, to edit or modify any Photo/Video/Story, or to request an entrant to modify, edit and/or re-submit his or her Photo/Video/Story, in order to ensure that the Photo/Video/Story complies with these Rules, or for any other reason. All eligible Photos, Videos and/or Stories, may, in the sole discretion of the Contest Sponsor, be posted to the Prairie Toyota Facebook page during the Contest Period, or as deemed appropriate by the Reviewer to keep consistent content continually being posted to the page. Whether a Photo/Video/Story is posted to the page, it is not connected with a particular Entrant’s eligibility in any draw as set out in Rule 6 below, and has no bearing on their chances of winning a prize in the Contest. If a Photo, Video or Story is deemed to be inappropriate or does not adhere to the Rules, as determined by the Contest Sponsor in its sole and absolute discretion, it may be disqualified from this Contest in the sole and absolute discretion of the Contest Sponsor.

By entering the Contest and submitting an Entry, each entrant: (i) grants to the Contest Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Photo(s)/Video(s)/Story (as applicable), in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Photo/Video/Story (as applicable) in favour of the Contest Sponsor; and (iii) agrees to release and hold harmless the Contest Parties and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Releasees”) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relate in any way to the Entry or any component thereof. For greater certainty, the Reviewer reserves the right, in its sole and absolute discretion and at any time during the Contest, to modify, edit or remove any Photo/Video/Story, or to request an Entrant to modify or edit his or her Photo/Video/Story, if a complaint is received with respect to the Entry, or for any other reason.

6. WINNER SELECTION: Starting September 3, 2012, and continuing on each of the Draw Dates indicated in the table to this section, in Calgary, AB at approximately 9:00 AM MT, 10 eligible winners will be randomly chosen from all eligible Entries received during the Contest Period prior to the Deadline for Entries associated with the applicable Draw Date. For greater certainty, all unsuccessful Entrants from all previous upload periods will go back into the general pool of Entrants and continue to be eligible for the duration of the Contest, or until drawn as a prize winner.

7. PRIZES: At the start of the Contest, there are two hundred (200) prizes. Each prize consists of one (1) twenty-five dollar ($25) gift card to Tim Horton’s (each a “Prize”). With the exception of the first week in the Contest Period, ten (10) prizes will be given away per week over the duration of the Contest Period.

Prizes will be awarded in the form of a Tim Horton’s gift cards. Gift Cards are subject to all terms and conditions placed on them by their issuer.

Maximum one (1) Prize per person/address/email during the Contest.

Any other costs or expenses incurred by the participant over and above the Prize will be the responsibility of the winner.

8. ODDS OF WINNING A PRIZE: The odds of winning any Prize depends upon the total number of eligible Entries received prior to the applicable Draw Date.  

9. NOTIFYING SELECTED WINNER: Before being confirmed as a winner, the selected Entrant will be required to correctly answer a mathematical skill-testing question without mechanical or other aid, and to sign and return all necessary release forms, as requested by the Contest Sponsor. By accepting a Prize, each winner (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; and (iii) agrees to release the Releasees from any and all claims, damages, liabilities, costs, and expenses arising from any liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof.  

Each person who qualifies to be a Prize winner in this Contest will be contacted by email within three weeks after the random draw takes place, as provided for in these Contest Rules. Each selected contestant will be disqualified if (a) she/he cannot be reached after three email attempts over the course of a maximum of 10 business days from the date of the first point of contact from the Contest Sponsor; or (b) the Contest Sponsor determines that the qualifying contestant is ineligible according to these Contest Rules; or (c) that person does not comply with the Contest Rules including correctly answering the skill-testing question; or (d) if his/her prize notification is returned to the Contest Sponsor as being undeliverable. In such case, the Contest Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible Entrant from among the remaining eligible Entrants (in which case the foregoing provisions of this section shall apply to such new selected Entrant). Arrangements for receiving a Prize will be made directly between each winner and the Contest Sponsor.  No Prize substitutions, transfers, or cash in lieu of the Prizes will be allowed.

10. CORRESPONDENCE AND COMMUNICATION: All correspondence and communication with contestants in connection with this Contest will be by email, except as otherwise noted. Notification of winner will be done strictly by email as listed in Section 9 (NOTIFYING SELECTED WINNER). Contestants agree to abide by these Contest Rules. The decision of the Contest Sponsor shall be final and binding in all matters related to the Contest. The Contest is subject to all applicable federal, provincial and municipal laws and is void where prohibited.

11. RELEASES: By entering this Contest, claiming or accepting a Prize in this Contest, and accepting these rules and regulations pertaining to the Contest, each Contestant consents to the use of his/her name, voice, picture, video (both moving and still) or likeness and Entry, without compensation, for promotional and/or publicity purposes as determined by the Contest Sponsor. The Prize winners agree to release the Contest Sponsor, its assignees, affiliates and associates named in the release from any and all liability, claims or actions of any kind whatsoever for injuries, damages or lost persons and property which may be sustained in connection with the receipt, entry for or use of a Prize. The Contest Sponsor may substitute one or more parts of a Prize with other merchandise or service of equal or greater value if, in the Contest Sponsor's opinion, the substitution becomes necessary.

12. NO LIABILITY: The Contest Sponsor reserves the right to change the terms of this Contest, suspend or cancel it, at any time, without liability on the part of the Contest Sponsor, and without prior notice. Contest Sponsor shall not be liable for late, lost, stolen, damaged, incomplete, misdirected, mislaid, illegible or unintelligible Entries. All Entries become property of the Contest Sponsor, which assume no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. If in the opinion the Contest Sponsor the administration or integrity of the Contest is compromised or corrupted at any time, the Contest Sponsor reserves the right to modify, suspend or cancel the Contest.

The Contest Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any Entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Contest Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

13. REFERENCES TO OTHER TRADE NAMES: The Contest website may contain references to other company, brand and/or product names. These company, brand and/or product names are used for identification purposes only and may be trade-marks of their respective owners. The images of people or places displayed, forms, structures and graphics displayed or found within the website are either the property of, or used with permission by Toyota Dealers Advertising Association - Prairie Zone. Toyota Dealers Advertising Association - Prairie Zone may be, but is not necessarily, sponsored by or affiliated with any owners of the other company, brand or product names appearing on the website, and makes no representations about them, their owners, their products or services.

14. PRIVACY: By entering this contest, each Entrant expressly consents to the Contest Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the Contest and in accordance with the Contest Sponsor’s Privacy Policy, unless the entrant otherwise agrees.
